				>	five (5) to seven (7) minutes, chances of survival are increased by forty-nine
				>	percent (49%).
	5	the guiding principle behind this policy is that hazing, bullying and harassment		5	every minute that goes by without defibrillation reduces the chance of survival
	>	have no place in any school environment.		>	by seven percent (7%) to ten percent (10%); (6) automated external defibrillator
				>	s (aeds) are extremely accurate computerized devices that can be operated by the
				>	average person; (7) aeds are inexpensive and grants for aeds are mostly given t

				>	grants from various organizations or through government agencies.
	6	this policy shall incorporate best practices as determined by the department and		6	(1) more than three hundred fifty-six thousand (356,000) sudden cardiac arrests

	>	opriate, team-level consequences, which may include the cancelation of a team’s
	>	season; (3) the recognition that consent by a person being subjected to an act o
	>	f hazing is not a defense under this section; (4) education and prevention compo
	>	nents that incorporate the opportunity to connect with any emerging statewide ef
	>	forts around school climate, anti-bullying, and anti-hate initiatives in rhode i
	>	sland schools; and (5) a requirement that each student-athlete subject to this p
	>	olicy shall, prior to attending any team practices, meetings, games, or other fu
	>	nctions, sign an acknowledgement and recognition that a violation of the policy
	>	may result in the imposition of penalties and sanctions.

				13	(b) definitions: as used in this section, the following words shall have the fol
				>	lowing meanings: (1) “athletic emergency action plan (eap)” means written guidel
				>	ines and templates for documentation of emergency planning to help prepare indiv
				>	iduals for a catastrophic injury situation within sports.
				14	(2) “automated external defibrillator (aed)” means a lightweight, portable devic
				>	e that delivers an electric shock through the chest to the heart.
				15	the shock can potentially stop an irregular heartbeat (arrhythmia) and allow a n
				>	ormal rhythm to resume following sudden cardiac arrest.
				16	(3) “cardiac emergency response plan (cerp)” means a written document that estab
				>	lishes the specific steps to reduce death from cardiac arrest in any setting, be
				>	it a school, community organization, workplace, or sports facility.
				17	(4) “sudden cardiac arrest (sca)” means when the heart malfunctions and stops be
				>	ating unexpectedly.
				18	if not treated within minutes, it quickly leads to death.
				19	(b) (c) all high schools and middle schools, whether they are public or privatel
				>	y run, shall provide and maintain on-site functional automated external defibril
				>	lators (aeds) in quantities and - page 2 of 5 types, deemed by the commissioner
				>	of education, in consultation with the director of health, accordance with guide
				>	lines set by the american heart association or an organization focused on emerge
				>	ncy cardiovascular care, and as outlined in subsections (d) and (e) of this sect
				>	ion, to be adequate to ensure ready and appropriate access for use during emerge
				>	ncies.
				20	whenever school facilities are used for school-sponsored or school-approved curr
				>	icular or extracurricular activities, and whenever a school-sponsored athletic c
				>	ontest is held at any location, the school officials and administrators responsi
				>	ble for such school facility or athletic contest shall ensure the presence of at
				>	least one person who is properly trained in cardio-pulmonary resuscitation (cpr
				>	) and the operation and use of an aed.
				21	such training may be conducted by qualified personnel, including, but not limite
				>	d to, municipal fire and police department employees.
				22	(d) establishing cardiac emergency response plans in schools.
				23	(1) beginning in the 2027-2028 school year, each high school and middle school s
				>	hall develop a cardiac emergency response plan (cerp) that addresses the appropr
				>	iate use of school personnel to respond to incidents involving an individual exp
				>	eriencing sudden cardiac arrest or a similar life-threatening emergency while on
				>	school grounds.
				24	(2) each cerp shall integrate evidence-based core elements, such as those recomm
				>	ended by american heart association guidelines or nationally-recognized, evidenc
				>	e-based standards focused on emergency cardiovascular care.
				25	(3) appropriate aed placement shall be determined by the cerp in accordance with
				>	guidelines set by the american heart association or an organization focused on
				>	emergency cardiovascular care.
				26	aeds shall be identified with appropriate signage and made available in an unloc
				>	ked location on school property.
				27	aeds shall be tested and maintained according to the manufacturer's operational
				>	guidelines.
				28	notification shall be provided to the appropriate emergency medical services pro
				>	vider regarding the aed, the type acquired, and its location.
				29	(4) appropriate school staff shall be trained in first aid, cpr, and aed use.
				30	training shall be consistent with national evidence-based emergency cardiovascul
				>	ar care guidelines.
				31	staff trained shall be determined by the cerp including, but not limited to, lic
				>	ensed coaches, school nurses, and athletic trainers.
				32	(e) establishing athletic emergency action plans (eaps) for high school and midd
				>	le school athletic venues and events.
				33	(1) beginning in the 2027-2028 school year, each high school and middle school w
				>	ith an athletic department or organized athletic program shall develop an athlet
				>	ic emergency action plan (eap) to respond to incidents of sudden cardiac arrest
				>	or a similar life-threatening emergency during a school athletic practice or eve
				>	nt.
				34	the eap shall follow nationally-recognized - page 3 of 5 recommendations and be
				>	venue-specific, posted, widely distributed, and rehearsed annually.
				35	(2) an aed shall be clearly marked and easily accessible in an unlocked location
				>	at each school athletic venue during any school-sponsored athletic event or tea
				>	m practice in which students of the school are participating.
				36	aeds shall be tested and maintained according to the manufacturer's operational
				>	guidelines.
				37	notification shall be provided to the appropriate emergency medical services pro
				>	vider regarding the aed, the type acquired, and its location.
				38	(3) all high school and middle school coaches shall obtain and maintain training
				>	in first aid, cpr, and aed use.
				39	certification in cpr and aed use shall be consistent with national evidence-base
				>	d emergency cardiovascular care guidelines.
				40	(f) implementation.
				41	(1) the commissioner of education, in collaboration with the director of the dep
				>	artment of health, may adopt rules and regulations to implement this section.
				42	(2) the commissioner of education, in collaboration with the director of the dep
				>	artment of health, shall establish a process to monitor compliance with this sec
				>	tion.
				43	(3) a local education agency may accept gifts, grants, and donations, including
				>	in-kind donations designated for the purchase of an aed that meets the standards
				>	established by the united states food and drug administration and for the costs
				>	incurred to inspect and maintain such device and train staff in the use of such
				>	device.
